Dispute resolution

The IChemE contract philosophy is directed towards the avoidance of disputes. However occasionally disputes arise which cannot be resolved in the normal course of discussion and negotiation. The IChemE's Forms of contract suite provides for several formal dispute resolution procedures as well as providing for the parties to agree to mediation as a way of resolving the differences between them. These include Rules for expert determination and Rules for dispute review boards, amongst only a few existing rules dealing with these forms of dispute resolution. They are incorporated into the Forms of contract suite (N.B. DRB for international contracts), or can be used alongside other contracts such as FIDIC, and are suitable for international use.

Dispute resolvers

IChemE not only sets out the mechanisms for dispute resolution throught its contracts, it also provides for the appointment on request of suitable persons to act as adjudicator, expert or arbitrator. Email contracts@icheme.org to request an appointment. As from 1 January 2012, IChemE will no longer be making its lists of dispute resolvers available. Any references in IChemE’s rules to the lists being publicly available are accordingly amended.
